YOUR INFORMATION. YOUR RIGHTS. OUR RESPONSIBILITIES.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, HOW YOU CAN ACCESS THIS INFORMATION, AND HOW TO FILE A PRIVACY COMPLAINT. PLEASE REVIEW IT CAREFULLY.

Q-Bit Wellness Pharmacy, operated by Skuint Pharmacy Solutions LLC, respects the privacy of patients and website visitors. We are required to protect the privacy and security of protected health information (PHI), provide this Notice, follow its current terms, and notify affected individuals and authorities of breaches as required by law. We follow applicable federal law and more protective California requirements, including the Confidentiality of Medical Information Act (CMIA).

1. Information We Collect and Maintain

We may collect names and contact details, date of birth, prescriptions, allergies, medication and vaccination history, prescriber information, insurance and payment details, medication therapy management and counseling records, delivery instructions, caregiver information, and information required for controlled-substance compliance. Access is limited according to workforce responsibilities.

2. Uses and Disclosures

Treatment: dispensing, counseling, immunizations, packaging, delivery, medication therapy management, and coordination with prescribers. Payment: insurance eligibility, claims, copay collection, reimbursement, reconciliation, disputes, and authorized payer or pharmacy benefit manager (PBM) audits. Healthcare operations: quality assurance, training, credentialing, administration, compliance, and fraud prevention. Other disclosures may be permitted or required by law, including public health, health oversight, judicial proceedings, law enforcement, workers’ compensation, and serious threats to health or safety. We disclose PHI to you and to the U.S. Department of Health and Human Services when required. We apply the minimum-necessary rule where applicable; treatment disclosures are generally excepted.

3. Business Associates and Service Providers

We use pharmacy software, billing, payment, delivery, reconciliation, hosting, and communications providers. When a vendor is a HIPAA business associate, we require an appropriate Business Associate Agreement and safeguards. Vendor access is limited to authorized purposes. We do not authorize unrelated commercial use of PHI.

4. Your Privacy Rights

You may ask to inspect or obtain copies of your health records, including an electronic copy where applicable; request a correction to information you believe is inaccurate or incomplete; request confidential communications at an alternative address or by another reasonable method; request restrictions on certain uses or disclosures; request an accounting of certain disclosures; and receive a paper copy of this Notice at any time. You may authorize a personal representative to act for you where permitted. We must honor qualifying requests to restrict disclosure to a health plan for payment or operations when the relevant item or service has been paid in full out of pocket, unless disclosure is required by law. Some requests are subject to legal exceptions; we will respond within applicable deadlines and explain any denial and review rights.

5. Your Choices and Written Authorization

We obtain written authorization when required, including for most uses of psychotherapy notes, sale of PHI, and certain marketing uses or disclosures not otherwise permitted. You may revoke an authorization in writing for future uses or disclosures, subject to actions already taken. We do not sell PHI. Where fundraising communications are legally permitted, applicable opt-out rights will be honored. You may tell us your preferences regarding communications with family, caregivers, or others involved in your care, subject to applicable law.

6. Substance Use Disorder Records (42 CFR Part 2)

Certain substance use disorder treatment records receive additional federal protections. When we maintain records subject to 42 CFR Part 2, we follow applicable consent, use, disclosure, redisclosure, and legal-proceeding restrictions. Such records or testimony about them generally cannot be used against a patient in civil, criminal, administrative, or legislative proceedings without the required written consent or qualifying court order and process. Where permitted, a consent may cover future treatment, payment, and healthcare operations. Applicable fundraising opt-out rights will be honored. This statement does not mean the pharmacy itself is a Part 2 program.

7. Patient and Caregiver Communications

We may contact you about prescriptions, refills, delivery, immunizations, appointments, and counseling. We may communicate with caregivers or others involved in your care as permitted by law, using reasonable safeguards. You may request confidential or alternative communication methods.

8. Delivery and Home-Based Services

For delivery, medication packaging, immunizations, and home-based medication services, authorized personnel receive only information reasonably necessary for their duties and must follow applicable confidentiality requirements.

9. Payer, PBM, and Regulatory Audits

We may disclose relevant prescription and billing records to authorized health plans, PBMs, auditors, government programs, and regulators as permitted or required by law. We verify request authority and scope, use appropriate secure transmission methods, and honor lawful inspection and retention obligations.

10. Safeguards and Breach Notification

We maintain administrative, physical, and technical safeguards, including role-based access, workforce training, authentication, vendor oversight, and incident response. No system is risk-free. We investigate suspected privacy or security incidents and notify affected persons and authorities as required by law.

11. Privacy Complaints and Contact

Contact the Q-Bit Wellness Pharmacy Privacy Officer at 1287 Hammerwood Avenue, Suite B, Sunnyvale, CA 94089; 650-206-9343; info@qbitwellness.com. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights: https://www.hhs.gov/ocr/complaints/. We will not retaliate against you for filing a complaint.

12. Changes to This Notice

We may revise this Notice and apply revised terms to PHI we maintain as permitted by law. The current version and its effective date will be available on our website and on request.

WEBSITE PRIVACY POLICY

13. Website Information

We may collect information you voluntarily submit through website inquiries, forms, or service requests, along with limited device, browser, and technical information necessary for website operation and security. General website forms should not be used to submit diagnoses, prescription photographs, insurance identifiers, or other sensitive medical information unless the form is specifically approved and secured for that purpose.

14. Website Service Providers and Tracking

Website hosting, security, analytics, and other vendors are subject to applicable privacy and contractual requirements. We do not authorize disclosure of PHI to advertising or tracking vendors without a lawful basis. Technologies involving PHI must meet applicable HIPAA requirements, including business associate agreements when required. External websites may have their own privacy policies.

15. California Privacy

We honor applicable California medical-information privacy requirements, including CMIA. Some HIPAA- or CMIA-regulated information may be exempt from portions of general California consumer privacy law. Contact the Privacy Officer to submit a request.

16. SMS Privacy and Mobile Information

If you choose to opt in to pharmacy service texts, we use your mobile number and consent information to administer the messaging program and provide requested service notifications. Mobile information and SMS opt-in consent data are not sold or shared with third parties or affiliates for their own marketing or promotional purposes. Authorized service providers may process messaging information only to deliver contracted services subject to appropriate safeguards. Ordinary carrier SMS may not adequately protect detailed PHI; do not send diagnoses, medication lists, insurance identifiers, or prescription photos by ordinary text. Our SMS Terms of Service explain message categories, consent, frequency, charges, STOP/HELP, and availability.
